Terms of Service

1. Acceptance of terms

By accessing or using Topokata ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms apply to all users, including visitors, registered users, and administrators. If you do not agree to these Terms, please do not use the Service. The Service is operated by Clever Tech Ltd, a company registered in Ghana.

2. Description of service

Topokata is a geo-spatial data collection platform that allows users to create forms, collect location-based responses, and export data in various GIS-compatible formats. Features vary by subscription plan.

3. Account registration

To use the Service, you must: • Be at least 18 years old, or have parental or guardian consent. • Provide accurate and complete registration information. • Keep your account credentials secure and not share them with others. • Notify us immediately of any unauthorised access to your account. You are responsible for all activity that occurs under your account.

4. Acceptable use

You agree not to use the Service to: • Collect data without the knowledge or consent of respondents. • Upload or distribute malicious code, spam, or illegal content. • Violate any applicable local, national, or international laws. • Attempt to gain unauthorised access to other accounts or systems. • Interfere with or disrupt the integrity or performance of the Service. • Reverse engineer, decompile, or otherwise attempt to extract the source code. We reserve the right to suspend or terminate accounts that violate these rules.

5. Subscription and billing

Some features of the Service require a paid subscription. By subscribing, you authorise us to charge the payment method on file at the beginning of each billing period. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time from your account settings. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial periods except where required by law.

6. Intellectual property

All content, features, and functionality of the Service — including but not limited to the interface, code, logos, and documentation — are the exclusive property of Clever Tech Ltd and are protected by intellectual property laws. You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited licence to store and process your data solely for the purpose of providing the Service.

7. Data and privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

8. Service availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled or emergency maintenance, which may result in temporary downtime. We will endeavour to notify users in advance of planned outages.

9. Limitation of liability

To the maximum extent permitted by law, Clever Tech Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

Either party may terminate the agreement at any time. You may delete your account at any time through the account settings. We reserve the right to suspend or terminate your account if you breach these Terms or engage in conduct we deem harmful to other users or to the Service.

11. Changes to these terms

We may revise these Terms at any time. If we make material changes, we will notify you by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of Ghana. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ghana.
